1. Insurance Object

Liability for damage caused by the use of the insured vehicle (hereinafter referred to as the insured vehicle) by a person whose civil liability is insured, to the life, health, and/or property of injured parties as a result of an insured event.

Only those types of vehicles that are defined by the Law can be secured.

2. Insurance Risks and Limitations

Insurance Risks:

A road traffic accident (hereinafter referred to as an RTA) involving the insured vehicle, which may result in liability for the person whose civil liability is insured.

Insurance Limitations:

Exclusions that are not recognized as insured events and are specified in Article 30 of the Law of Ukraine "On Mandatory Insurance of Civil Liability of Owners of Land Vehicles" dated May 21, 2024.

3. Minimum and Maximum Insurance Coverage Amounts (Liability Limits)

The insurance coverage amounts are as follows:

For damages to the life and health of injured persons: UAH 500,000 per injured person, but not more than UAH 5,000,000 per insured event.
For damages to the property of injured persons: UAH 250,000 per injured person, but not more than UAH 1,250,000 per insured event.
If an accident causes damages to the life, health, and/or property of multiple injured persons and the insurance amount is insufficient to fully compensate them, the insurance payout is distributed proportionally among the injured parties who file claims within 30 days of the accident.

4. Minimum and Maximum Insurance Premiums and Tariffs

The amount of the insurance premium under the insurance contract is determined by the insurer at the time of concluding the contract in accordance with the approved tariff policy for this insurance product.

5. Type, Minimum, and Maximum Deductibles (if applicable)

No deductible applies under the insurance policy.

6. Territory and duration of the insurance contract (including information on the procedure for its entry into force and the insurance period(s), if applicable)

Insurance Territory: Ukraine, excluding:

Temporarily occupied territories;
Territories where state authorities do not exercise their powers, and settlements located along the demarcation line;
Areas of military operations of any nature.
Policy Term: 6 months or 1 year.

Contracts for less than 6 months (15, 21, 30, 60, 90, 120, or 150 days) are allowed only for vehicles that:

Are not registered in accordance with the Law on Road Traffic — for the period until registration.
Are temporarily in Ukraine and registered in a foreign state — for the duration of their stay in Ukraine.
The policy becomes effective on the date specified as the start date in the contract but no earlier than the day after the insurer receives the premium payment (or the first part of the premium if paid in installments) in the amount and within the timeframe specified in the contract.

7. Possible consequences for the consumer in case of failure to fulfill obligations under the insurance contract

If the consumer fails to fulfill the obligations stipulated in the insurance contract, the insurer may refuse to pay insurance compensation.

8. Information on the possibility of purchasing the insurance product separately

The insurance product is not an add-on to other goods, works, or services that are not insurance-related.

9. Conditions for obtaining a discount on the insurance product and the insurer's promotional offers

Discounts and promotional offers are not provided for the insurance product. However, according to the law, a benefit is available that reduces the insurance payment by 50% for certain categories of Ukrainian citizens, as specified in Section 13, "Information about the Insurance Product," below.

10. List of information essential for assessing insurance risk and/or other factors considered when determining the insurance premium amount

Information essential for assessing insurance risk includes:
- Details of the insured vehicle as specified in its registration certificate;
- The age and driving experience of the owner/drivers authorized to operate the vehicle;
- The nature and/or intensity of the insured vehicle's use (e.g., taxi services, rental, leasing, etc.);
- Previous traffic accidents involving the Policyholder and/or other drivers authorized to operate the insured vehicle before the contract was concluded (including accidents covered by insurance contracts with other insurers);
- All active insurance contracts related to the insured vehicle.

11. Procedure for Concluding and Paying for the Compulsory Civil Liability Insurance Contract for Owners of Land Vehicles

Procedure for Concluding the Insurance Contract:

1. Determining the Client’s Needs: Before concluding the insurance contract, the Insurer (or insurance intermediary) clarifies the client’s requirements and needs orally, through correspondence, or by filling out relevant forms on the website. Based on the provided information, an offer is prepared.
2. Providing Information to the Client: The client is provided with clear and comprehensive information about the insurance product, the Insurer, and the intermediary (if applicable), including by publishing relevant details on the Insurer’s/insurance intermediary’s website.
3. Disclosure of Essential Information by the Client: Before concluding the contract, the client must disclose to the Insurer/insurance intermediary all known circumstances that are essential for assessing the insurance risk.
4. Contract Conclusion: Once all essential terms of the contract have been agreed upon, the parties conclude the contract exclusively in written form as an electronic document signed with an electronic signature by both parties.
5. Steps for Concluding the Contract through the Insurer’s/Insurance Intermediary’s Information and Communication System (hereinafter – ICS):
1) Client identification in the ICS and provision of necessary information for preparing the offer.
2) The Insurer forms a contract proposal, which is registered in the Unified Central Database of the Motor (Transport) Insurance Bureau of Ukraine (hereinafter – UCDB MTIBU), sent to the client via ICS, and remains valid until the end of the day it was created or no later than the contract's effective date and time.
3) The MTIBU ensures the possibility of verifying the registration of the proposal in the UCDB MTIBU and publishes information on its website on how to verify the fact of registration of an electronic contract proposal.
4) The client agrees to the proposal and signs the contract.
5) The contract is signed by the authorized representative of the Insurer/insurance intermediary.
6) The contract is registered in the UCDB MTIBU, and a copy signed by both parties is sent to the client via electronic and/or mobile communication or placed in the personal account at my.UNIQA.ua.

Procedure for Paying the Insurance Contract:

The insurance premium under the Contract is paid in full as a one-time payment before or at the time of contract conclusion.

12. Methods for Obtaining Information on the Registration of the Compulsory Civil Liability Insurance Contract for Land Vehicle Owners in the Unified Central Database

The validity, availability, and status of the insurance contract in the UCDB MTIBU can be verified:
- By scanning the QR code located on the first page of the insurance contract; or
- Directly on the MTIBU website at the following link: [https://mtsbu.ua/avtocivilka/perevirka-chinnosti-polisuhttps://mtsbu.ua/avtocivilka/perevirka-chinnosti-polisu.

13. List of Categories of Individuals Entitled to a Reduced Insurance Premium (for Domestic Compulsory Civil Liability Insurance Contracts for Land Vehicle Owners)

Under Ukrainian law, a benefit is provided that reduces the insurance premium by 50% for Ukrainian citizens who fall into one of the following categories:
- Combatants, war veterans;
- Injured participants of the Revolution of Dignity;
- Persons with disabilities of groups I and II;
- Persons with disabilities as a result of war;
- Persons affected by the Chornobyl disaster classified under categories I or II;
- Pensioners.

This benefit applies if the vehicle:
- Has an engine capacity of up to 2500 cm³ or an electric motor power of up to 100 kW;
- Is owned by the eligible person and used by them either personally or by another eligible person, without being used for commercial passenger or cargo transportation.

14. Information on the Validity of the Compulsory Civil Liability Insurance Contract for Land Vehicle Owners in Case of a Change in Ownership of the Insured Vehicle

If the ownership of the insured vehicle changes due to its lawful transfer, the compulsory civil liability insurance contract remains valid until its expiration, and the rights and obligations of the policyholder are transferred to the new owner of the specified vehicle.

In the event of the death of the policyholder (an individual), their rights and obligations under the compulsory civil liability insurance contract are transferred to the person who inherits the vehicle specified in the contract and/or is considered to have accepted the inheritance under the provisions of the Civil Code of Ukraine.

The right to receive a portion of the insurance premium in case of early termination of the insurance contract due to the death of the policyholder (an individual) is transferred to the person who inherits the vehicle specified in the contract and/or is considered to have accepted the inheritance under the provisions of the Civil Code of Ukraine.

If the ownership of the insured vehicle changes, the new owner must notify the insurer in writing within 15 calendar days from the date of acquiring ownership and provide their personal information.

16. Grounds and Procedure for the MTIBU’s Regulatory Payment in the Case Specified in Clause 4, Part 1, Article 43 of the Law of Ukraine "On Compulsory Civil Liability Insurance for Land Vehicle Owners," or a Link to the MTIBU Webpage Containing Information on the Procedure for Regulatory Payments

If damage is caused on the territory of Ukraine by a vehicle that, on the date of the traffic accident, was insured under a domestic insurance contract with an insurer that, on the date of the regulatory payment request, no longer had the right to provide compulsory civil liability insurance due to the termination of its MTIBU membership, and such an insurer (or its successor) did not make a decision regarding the insurance payment within the period established by the Law "On Compulsory Civil Liability Insurance for Land Vehicle Owners" dated 21.05.2024 (hereinafter – Law 3720), or made a decision to make the insurance payment but failed to execute it, or in the event of bankruptcy or liquidation of the insurer, the MTIBU will provide a regulatory payment from the Victim Protection Fund under the conditions specified in Law 3720. This payment is made within the insurance limits applicable on the day of the insurance contract's conclusion.

17. Procedure for Consumer Actions to Obtain an Insurance Payment Through Direct Settlement (for a Domestic Compulsory Civil Liability Insurance Contract for Land Vehicle Owners)

The injured party may exercise their right to direct settlement and submit a claim for an insurance payment to their own insurer if:
- The traffic accident involved only two (2) vehicles;
- The injured party sustained damage exclusively in the form of vehicle damage or total loss, without harm to life or health.

In all other cases, the claim for an insurance payment must be submitted exclusively to the insurer of the responsible party.

An injured party who has exercised the right to direct settlement and submitted a claim for an insurance payment to their own insurer loses the right to submit a claim to the responsible party’s insurer. Likewise, an injured party who did not exercise the right to direct settlement and instead submitted a claim to the responsible party’s insurer loses the right to claim from their own insurer.

The insurer of the injured party who receives the insurance claim is obligated to:
- Process and accept the claim if, at the time of submission, the insurer is a member of MTIBU, the accident circumstances meet the direct settlement criteria mentioned in the first paragraph of this section, and the injured party has provided a written statement confirming that no claim was submitted to the responsible party’s insurer.
- Review the claim, make a decision based on the review, and, if no grounds exist for denying payment (as outlined in Article 30 of Law 3720), make the insurance payment.

If the injured party’s insurer discovers that a claim was previously submitted to the responsible party’s insurer, the injured party’s insurer has the right to return the claim without processing it.
