1 Object of Insurance

Property owned, used, or disposed of under lawful possession as specified in the insurance contract, as well as the liability of the Policyholder (or the person whose liability is insured) for damage caused to a third party or their property in connection with the operation of the Insured Property, and which are associated with:

  • the insurance interests of the Policyholder (Beneficiary);
  • the insurance risks covered by the Contract.
2 Insurance Risks. Insured Events. Insurance Limitations

The Contract is concluded under one of the insurance product programs, namely:

  • Program “Standard Conditions” — provides a standard list of risks (items 1–7 below);
  • Program “War Risks” — provides both standard and war-related risks (items 1–8 below).

Insurance risk:

  1. fire;
  2. explosion;
  3. natural phenomena: storm, soil subsidence, hurricane, gale, tornado, squall, earthquake, flood, high water, inundation, groundwater activity, heavy rain, snowfall, ice drift, icing, blizzard, snow pressure, landslide, collapse, rockfall, avalanche, mudflow;
  4. hail, frost;
  5. unlawful acts of third parties (burglary, robbery, assault, arson);
  6. water or liquid leakage from plumbing, sewage, heating, or other hydraulic systems due to damage;
  7. other accidental events: collision with ground or water vehicles, self-propelled floating structures, or falling trees and other objects onto the Insured Property;
  8. war risks: missile strikes, unmanned aerial vehicles of any type, air defense or missile defense systems, their debris, or shock waves caused by such weapons (this risk applies only to the “War Risks” program and is covered once during the annual term of the Contract).

Insured event:

  • damage, destruction, or loss of the Insured Property as a result of the occurrence of insured risks;
  • the Policyholder’s liability or that of a person lawfully operating the Insured Property towards a third party for damage caused as a result of insured risks occurring during the operation of the property.

Insurance limitations:

The following are not subject to insurance under this product:

  • summer and garden houses, garages built separately from the residential building, not forming part of the household according to title documents, or located outside its territory;
  • houses (or individual premises in apartment buildings) owned by an individual but used for commercial purposes;
  • property located in areas excluded from insurance coverage;
  • any other property except residential real estate (apartments, houses).
3 Minimum and Maximum Insurance Amounts (Liability Limits)

The total insurance amount depends on the insurance program selected by the Policyholder when concluding the Contract:

  1. Program “Standard Conditions”: UAH 50,000 – 250,000;
  2. Program “War Risks”: UAH 50,000 – 125,000.

Insurance payment limits as a percentage of the insured amount:
– 20% for structural elements and engineering systems;
– 40% for interior finishing (repairs);
– 20% to cover damage caused to third-party property (neighbors);
– 20% to cover damage caused to the life or health of third parties (neighbors).

4 Minimum and Maximum Amounts of the Insurance Premium and/or Insurance Rate

Insurance rate, % of the insured amount:
Program “Standard Conditions”: 0.48% – 0.60%;
Program “War Risks”: 1.68%.

Insurance premium (annual):
Program “Standard Conditions”: UAH 300 – 1200;
Program “War Risks”: UAH 840 – 2100.

5 Type, Minimum and Maximum Deductible Amounts (if applicable)

Not applicable.

6 Territory and Term of the Insurance Contract (including information on the procedure for its entry into force and the insurance period(s), if applicable)

Territory of insurance: the location of the insured property within the territory of Ukraine.

The insurance contract does not apply to:

  • temporarily occupied territories; territories where the state authorities of Ukraine temporarily do not exercise their powers; territories located along the contact line; areas of active hostilities where military actions are taking place;
  • territories where a state-level emergency situation of a technogenic or natural nature has been officially declared.

For the “War Risks” insurance risk, the Contract does not apply to:

1) the territories of Donetsk, Luhansk, Kherson, Mykolaiv, Zaporizhzhia, Kharkiv, Dnipropetrovsk, Sumy, Chernihiv, Odesa regions, and the Autonomous Republic of Crimea;

2) temporarily occupied territories; territories where the state authorities of Ukraine temporarily do not exercise their powers; territories along the contact line; areas of active hostilities where combat operations are taking place (including those with functioning state electronic information resources) — if, as of the date of the event having the characteristics of an insured event, no official end date of occupation or hostilities has been defined. The status of such territories is determined according to the List approved by the Ministry for Reintegration of the Temporarily Occupied Territories of Ukraine as of the date of the event.

3) territories located less than 100 km from those listed in subparagraph 2 or from the Ukrainian-Russian border. The distance is measured by a straight line from the coordinates of the event location to the nearest coordinates of the mentioned territories or the Ukrainian-Russian border as of the event date. The Insurer may use the web service https://deepstatemap.live/ or the Google Maps distance measurement tool (www.google.com/maps).

Contract term — 1 year with automatic renewal for each subsequent year, provided that:
— no notice of termination is received from the Insurer or Policyholder within 30 calendar days before the expiration date of the Contract, and
— the insurance payment is continued.

The insurance contract takes effect at 00:00 (Kyiv time) on the start date specified in the Contract, but not earlier than the day following the payment of the insurance premium to the Insurer’s account. The Contract remains valid until 24:00 (Kyiv time) on the end date unless terminated earlier.

The contract period is divided into insurance periods lasting:

— 1 year — in case of a one-time payment;
— 1 month — in case of monthly payments.
Insurance coverage in each period is valid only upon payment of the insurance premium for that period.

The insurance contract terminates if the Insurer does not receive the due insurance payments in full for six (6) consecutive months.

The contract establishes a waiting period — a time interval during which insurance coverage does not apply: the first 7 (seven) days from the effective date of the contract.

7 Possible consequences for the consumer in case of failure to fulfill obligations defined in the insurance contract

Failure by the Policyholder to fulfill the obligations defined in the insurance contract may serve as grounds for the Insurer to refuse payment of the insurance compensation.

The Insurer has the right to refuse the insurance payment if the Policyholder fails to perform the actions stipulated by the insurance contract upon the occurrence of an event that has the characteristics of an insured event.

Events that occur during an insurance period for which the insurance premium has not been paid within the time limits established by the contract shall not be recognized as insured events.

8 Information on the possibility to purchase the insurance product separately, if such product is offered together with an ancillary and/or additional good, work or service that is not insurance-related, as part of a single package or contract

The Contract is not an addition to any other goods, works, or services that are not insurance-related. In connection with the conclusion of the Contract, there is no need to obtain any additional or ancillary services from the Insurer and/or third parties related to the provision of the financial service under the Contract.

9 Terms of obtaining discounts on the insurance product and promotional offers of the insurer (if any), including their validity periods

Discounts and promotional offers are not available and do not apply.

10 List of information essential for assessing the insurance risk and/or information on other circumstances considered when determining the amount of the insurance premium

When concluding the Contract, the Policyholder must provide the Insurer with information on the existence of an insurable interest regarding the insured property, as well as all known circumstances that are essential for assessing the insurance risk (determining the probability and likelihood of the occurrence of an insured event and the potential amount of losses). Furthermore, the Policyholder must inform the Insurer of any change in the insurance risk no later than 5 (five) working days after such change occurs. The conclusion of the Contract by the Policyholder in respect of property that cannot be insured according to clauses 5.2 and 5.3 of the General Terms and Conditions of the insurance product shall be considered a breach of this obligation.

The information that is essential for the Insurer’s decision to conclude the Contract and/or for assessing the insurance risk includes:

  • data on the insured property specified in the Contract;
  • losses related to the insured property that occurred before the conclusion of the Contract (including under contracts with other insurers);
  • all valid insurance contracts concluded for the insured property;
  • the existence of legal grounds and insurable interest of the Policyholder and Beneficiary for entering into the Contract.
11 Consumer notice on the need to review information before entering into the insurance contract, including links to such information

The consumer must review, prior to concluding the insurance contract, the information on exclusions from insured events and grounds for refusal of insurance payments, the insurer’s liability limits for each insured object, insurance risk and/or insured event, as well as the calculation procedure and conditions for insurance payments, which are contained in the General Terms and Conditions of the insurance product “Property Without Inspection” (the public part of the insurance contract), available at: https://uniqa.ua/storage/public-offer/partner-reports/2107_umovy.pdf
