1 Object of insurance

The subject matter of the insurance is:

  • under insurance class 3: property held under a right of possession and/or use and/or disposal, namely: a motor vehicle (hereinafter referred to as ‘MV’) in respect of which the Policyholder has an insurable interest;
  • under insurance class 10: liability insurance arising from the use (operation) of land vehicles (including rail transport), other than that specified in the Law of Ukraine ‘On Compulsory Insurance of Civil Liability of Owners of Land Vehicles’, where the Contract provides for insurance under the specified class (risk within the class) (hereinafter – the Contract);
  • under insurance class 1: life, health and working capacity of the driver and/or passengers of the insured Vehicle.
2 Insurance risks. Insurance limitations

Insurance risks:

In respect of Casco:

  • Illegal appropriation committed through theft, robbery, assault;
  • Traffic accidents, including stones thrown from under wheels, collisions with animals during vehicle movement;
  • Unlawful actions of third parties;
  • Natural disaster: flood, storm, hurricane, tornado, squall, heavy rain, hail, landslide, avalanche, mudslide, groundwater rise, lightning strike, soil subsidence, earthquake, etc.;
  • Fire, explosion, or spontaneous combustion;
  • Spontaneous fall of trees, rocks, or other objects; animal attacks; vehicle damage by water or other objects or liquids due to utility network accidents; vehicle damage due to sinking under road pavement (hereinafter – Other cases).

In respect of third-party liability: the occurrence of liability for damage caused to the life, health and/or property of an injured third party as a result of a road traffic accident during the use (operation) of the insured vehicle by the person whose liability is insured.

In respect of accidents: the occurrence of losses as a result of events covered by comprehensive motor insurance, provided they arose from a transport accident that took place during the term and within the territory of the Policy, and provided a direct causal link has been established between the transport accident and the insured person’s incapacity for work or death.

Insurance limitations:

Under the CASCO section, the following are not covered:

  • vehicles that are not registered in Ukraine or are not subject to state registration;
  • vehicles that are in a technically faulty condition and cannot be admitted to road traffic in accordance with the requirements of the Highway Code (hereinafter – HC);
  • vehicles without a chassis number (if not provided by the manufacturer or if destroyed);
  • vehicles used for driving lessons or participating in competitions;
  • vehicles for military use or mine clearance services;
  • vehicles over 15 (fifteen) years old;
  • vehicles of types other than passenger cars, motorcycles, goods vehicles, buses and trailers (e.g. specialised equipment, etc.).

In respect of third-party liability the following vehicles cannot be insured:

  • those specified in the paragraph above;
  • water, air and other forms of transport, other than land transport;
    rail transport.

In respect of accidents, insurance is not provided for occupational injuries or occupational diseases. 

3 Minimum and maximum insurance sum (liability limit)

In respect of Casco: there are no limits on the minimum or maximum sum insured. The sum insured is non-aggregate, is determined by agreement between the Parties, and must correspond to the actual value of the vehicle at the time the insurance contract is concluded.

In respect of third-party liability: the minimum sum insured (total liability limit) per vehicle is UAH 500,000; the maximum sum insured (total liability limit) per vehicle is UAH 1,000,000.

Within the general limit of liability under the motor insurance policy, the following limits are established:

  • the limit of liability for damage caused to the life or health of third parties is UAH 50,000 (fifty thousand hryvnias);
  • the liability limit for damage caused to the property of third parties is determined as the difference between the total liability limit and the liability limit for damage caused to the life or health of third parties.

In respect of accidents: the minimum sum insured per vehicle is 500,000 UAH, the maximum sum insured per vehicle is 1,000,000 UAH.

4 Minimum and maximum insurance premium and/or tariff

The amount of the insurance premium depends on the sum insured (limit of liability), the chosen insurance terms and conditions, and the type of vehicle.

The minimum and maximum amounts of the total annual insurance premium range from 10,000 UAH to 500,000 UAH.

5 Type, minimum and maximum deductible (if any)

In respect of Casco: the excess is set as a percentage of the sum insured or as a monetary amount in US dollars, euros or Ukrainian hryvnia, as agreed by the Parties, and is chosen by the Policyholder from the following options: 0%, 0.5%, 1% or 2% of the sum insured. If an unconditional excess in monetary terms of the currency is applied when calculating the insurance indemnity, the conversion into the national currency is carried out using the NBU exchange rate on the date of the insured event.

Additional excess. If persons under the age of 23 are permitted to drive the vehicle, the Contract must state ‘no age restriction’. If the Contract states ‘over 23 years of age’ (the Policyholder is not entitled to allow persons under the age of 23 to drive the vehicle), but if, at the time of the insured event involving a road traffic accident, the vehicle was being driven by a person under the age of 23, the Insurer shall pay the insurance indemnity less a deductible of 20% (twenty per cent) of the sum insured for such insured event.

In respect of third-party liability: no deduction is made.

In respect of accidents: no deduction is made.

6 Territory and term of the insurance contract (including information on the procedure for its commencement and insurance period(s), if any)

Territory of insurance: Ukraine, European countries and CIS (excluding the Republic of Belarus and the Russian Federation), Georgia, Turkey.

The insurance contract does not cover:

  • areas of military conflicts, armed conflicts, mass disturbances,
  • temporarily occupied territories of Ukraine as defined by the laws and regulations of Ukraine,
  • territories of Ukraine where state authorities are temporarily unable to exercise their powers, and settlements and territories located on the demarcation line and/or the line of contact,
  • territories where active military operations and/or active hostilities of any nature are taking place, regardless of whether war has been officially recognised under the law;
  • areas where a state of emergency has been officially declared or territories that have the status of, or are officially recognised by the competent state authorities as, a zone of potential natural disaster, provided such a declaration was made prior to the conclusion of the insurance contract,
  • routes where sporting events are held.

The term of the insurance contract is up to 10 years. Annual insurance periods are established within the overall term of the Contract. The Contract provides for the possibility of extending its term in accordance with the procedure set out in the Contract.

The insurance contract comes into force and the insurance cover takes effect from 00:00 hours on the date specified in the contract as the start date of the first annual insurance period and remains in force until the date specified in the insurance contract as the end date of the last annual insurance period.

The contract is renewed for the next annual insurance period on the same terms, provided that the annual (regular) insurance premium is paid in full for the next annual insurance period no later than the date specified in the insurance contract as the deadline for payment, and provided that neither Party to the insurance contract gives written notice of their intention to terminate it 30 (thirty) calendar days prior to the expiry date of the current annual insurance period.

7 Possible consequences for the consumer in case of failure to fulfill the obligations defined by the insurance contract

If the consumer fails to fulfill the obligations defined by the insurance contract, payment of insurance compensation may be refused.

8 Information about the possibility to purchase the insurance product separately

The insurance product is not an add-on to other goods, works, or services that are not insurance-related.

9 Conditions for obtaining a discount on the insurance product and the insurer’s promotional offers

Discounts and promotional offers are not provided for this insurance product.

10 List of information essential for assessing the insurance risk, and/or information on other circumstances considered when determining the amount of the insurance premium

Information essential for the Insurer’s decision on the insurance premium under the contract and the assessment of the insurance risk includes details about:

  • the insured vehicle as specified in the vehicle registration certificate;
  • the country of origin of the vehicle;
  • drivers authorized to operate the insured vehicle;
  • the main territory of use, nature and/or intensity of operation of the vehicle;
  • the technical condition of the vehicle;
  • any existing damage or identified hidden defects;
  • losses related to the insured vehicle that occurred before the conclusion of the insurance contract (including under contracts with other insurers);
  • all active insurance contracts concluded in relation to the insured vehicle;
  • the existence of legal grounds or other legal relations establishing an insurable interest for the Policyholder and the Beneficiary regarding the vehicle;
  • any change of ownership of the vehicle (sale, donation, etc.), issuance of a power of attorney with the right to dispose of the vehicle to another person, conclusion of a preliminary sales agreement, or receipt of a deposit;
  • replacement of the body or engine, installation of additional equipment and/or replacement of vehicle components with ones different from those accepted for insurance, including modifications requiring registration of such changes with the competent authorities, registration (re-registration) of the vehicle;
  • removal of the vehicle from state registration, cancellation of registration;
  • the vehicle being under search, arrest, or encumbrance (except encumbrance related to the fulfillment of contractual relations of the Policyholder with the Beneficiary);
  • transfer of the vehicle for rent/sublease, hire, car sharing, pledge, leasing/subleasing, or use as a taxi;
  • loss of registration documents and/or keys to the insured vehicle and/or key fobs, remote controls for the alarm system;
  • errors, malfunction of computer equipment, software, or built-in microchips, components;
  • breakdown, removal, deactivation, or replacement of anti-theft devices.
11 Notice to the consumer on the need to review information before concluding the insurance contract, including links to such information

The insurance product comprises two insurance schemes:

  • for vehicles purchased under the Porsche Mobility finance scheme;
  • for vehicles purchased under the Porsche Leasing scheme.

The information set out in the table above under points 1–11 applies equally to both schemes.

The differences between the programmes relate exclusively to the definition of the Policyholder and the Beneficiary, as well as their rights and obligations.
Insurance risks and insurance exclusions, minimum and maximum sums insured (limits of liability), insurance premiums and/or insurance rates, the type and amount of excess, the territory and term of the insurance contract are the same for both programmes and do not depend on the programme chosen.
