The insurance product ‘International compulsory civil liability insurance for owners of land vehicles’ is a product of IC ‘PZU Ukraine’, which IC ‘UNIQA’ sells as an insurance agent.

1 Insurance object

Property interests that do not contradict Ukrainian legislation are related to compensation by a person whose civil liability is insured for damage caused to the life, health, and property of victims as a result of the operation of the insured vehicle (hereinafter referred to as the vehicle). Information about the land vehicle accepted for insurance must be entered into the Unified State Register of Vehicles provided for by the Law of Ukraine ‘On Road Traffic’.

2 Insurance risks. Insurance restrictions

Determined by the legislation on compulsory civil liability insurance for owners of land vehicles in the country of visit where the insured event occurred, taking into account the rules of the Green Card international motor insurance system.

3 The minimum and maximum amounts of the insured sum (liability limit), if the minimum and maximum amounts of the insured sum are specified in the terms and conditions of the insurance product

The amount of insurance coverage and/or liability limits are determined by the legislation on compulsory civil liability insurance for owners of land vehicles in the country of visit where the insured event occurred, taking into account the rules of the Green Card international motor insurance system.

Reference summary information on the amounts of insurance coverage and/or liability limits applicable in each country that is a member of the Green Card international motor insurance system is posted and periodically updated on the Council Bureau website (www.cobx.org). As of 03.12.2024, this information is available on the website in the Documents directory under the title Minimum amounts of insurance coverage / Summary tables of the minimum amounts of insurance coverage as reported by the Green Card Bureaux.

4 Minimum and maximum amounts of insurance premium and/or insurance tariff

The amount of the insurance payment (contribution, premium) is determined by the Insurer independently on the basis of the methodology for calculating the insurance tariff for the relevant insurance product, developed and approved by the Insurer in compliance with the requirements of insurance legislation, including taking into account the need to ensure compliance with the requirements of legislation regarding the solvency of the Insurer, the formation of guarantee funds of the Motor Transport Insurance Bureau of Ukraine and other requirements established by law.

  • The minimum possible value of the insurance premium is 50 UAH.
  • The maximum possible value of the insurance premium is 100,000 UAH.
5 Type, minimum and maximum franchise amounts (if applicable)

Absent (equal to zero).

6 Territory and term of the insurance contract (including information on the procedure for its entry into force and the insurance period(s) (if any))

Territory of validity

The insurance contract is valid in the countries specified and not crossed out in the Green Card certificate issued by the Insurer. The coverage provided by Green Cards issued for the Republics of Azerbaijan, Cyprus and Serbia is limited to those geographical areas of such countries that are under the control of their governments. Term

The insurance contract may be concluded for a term of 15 days, 21 days, 1 month, 2 months, 3 months, 4 months, 5 months, 6 months, 7 months, 8 months, 9 months, 10 months, 11 months or one year.

7 Exceptions to insured events and grounds for refusal to make insurance payments

Determined by the legislation on compulsory civil liability insurance for owners of land vehicles in the country of visit where the insured event occurred, taking into account the rules of the Green Card international motor insurance system.

8 Limits of the insurer's liability for a specific object of insurance, insurance risk and/or insured event, group of insurance risks and/or insured events (if any), other components of the insurance product

Determined by the legislation on compulsory civil liability insurance for owners of land vehicles in the country of visit where the insured event occurred, taking into account the rules of the Green Card international motor insurance system.

9 Procedure for calculating and conditions for making insurance payments

Determined by the legislation on compulsory civil liability insurance for owners of land vehicles in the country of visit where the insured event occurred, taking into account the rules of the Green Card international motor insurance system.

10 Possible consequences for the consumer in case of failure to fulfil their obligations under the insurance contract
  1. An insured person who, when concluding an insurance contract, provided information that is essential for assessing the insurance risk and/or information about other circumstances that are taken into account when determining the amount of the insurance premium under the contract, which turned out to be inaccurate, resulting in a reduction in the amount of the insurance premium under such a contract, is obliged pay the Insurer who made the insurance payment a penalty in the amount of five times the insurance premium under such a contract, but not more than 50 per cent of the insurance payment.
  2. If the terms of the insurance contract provide for restrictions on the conditions of use of the insured vehicle, the person who caused the road traffic accident and used the insured vehicle in violation of such conditions shall be obliged to pay the Insurer who made the insurance payment a penalty in the amount of ten times the insurance premium under such contract, but not more than 50 per cent of such insurance payment.
  3. If the failure (improper performance) by the relevant person to fulfil the obligation provided for in part two of Article 33 of the Law on Compulsory Motor Third Party Liability Insurance has led to a violation of the deadline for making the insurance payment, the Insurer who made the insurance payment shall have the right to receive compensation from such person in the amount of losses incurred by the Insurer in accordance with part eight of Article 34 of the Law on Compulsory Civil Liability Insurance.

The legislation on compulsory civil liability insurance for owners of land vehicles in the country where the insured event occurred may stipulate additional consequences for the consumer in the event of failure to fulfil the obligations specified in the insurance contract.

11 Information on the possibility of purchasing an insurance product separately, if such a product is offered together with a related and/or additional non-insurance product, work or service as part of a single package or contract

The insurance product is not supplementary to other goods, works or services that are not insurance-related.

13 Terms and conditions for obtaining a discount on an insurance product and promotional offers from the insurer (if any), including their validity periods

No discounts or promotional offers are available for this insurance product.

14 List of information that is essential for assessing insurance risk and/or information about other circumstances that are taken into account when determining the amount of the insurance premium

Information that is essential for assessing insurance risk includes details about:

  • the policyholder;
  • the vehicle;
  • the vehicle owner and driver;
  • the nature and/or intensity of vehicle use;
  • the field and/or type of activity in which the vehicle is used (in particular, whether it is used to provide courier services or belongs to a courier service; whether it can be rented out or belongs to a rental organisation, etc.);
  • whether the vehicle can be used to provide paid passenger and/or cargo transportation services and/or as a taxi (in particular, in Uklon, UBER, BOLT and other similar services).
 15 Procedure for concluding and paying for the contract
  1. The agreement shall be concluded in writing in accordance with the requirements of the Civil Code of Ukraine for the written form of a transaction and the requirements of this Law, and shall be created in paper form or in the form of an electronic document in accordance with the requirements of the Laws of Ukraine ‘On Electronic Documents and Electronic Document Management’ and ‘On Electronic Identification and Electronic Trust Services’ or in accordance with the procedure provided for by the legislation on electronic commerce.

The contract shall be concluded in accordance with the general terms and conditions of the insurance product, which complies with the terms and conditions of the Law on Motor Third Party Liability Insurance, and shall consist of the general terms and conditions of the insurance product and the individual part of the contract. The insurance policy shall contain information that meets the requirements for the individual part of the contract and shall be a document certifying the conclusion of the contract.

  1. The person who applied for the conclusion of the contract shall provide the Insurer with information that is essential for assessing the insurance risk and/or information about other circumstances that are taken into account when determining the amount of the insurance premium under the contract, in the form and manner determined by the Insurer.

The insurer is obliged to publish on its website a list of information that is essential for assessing insurance risk and/or information about other circumstances that are taken into account when determining the amount of the insurance premium under the contract.

If a person has applied to an insurance intermediary to conclude a contract, the insurance intermediary is obliged to familiarise them with the information provided for in the previous paragraph.

  1. The insurance contract shall enter into force at 00:00 hours on the date of commencement of its term as specified in the contract, but not earlier than the beginning of the day following the entry of such contract into the Unified Centralised Database, and shall terminate at 24:00 hours on the date specified in the contract as the date of termination of the contract.

The insurance premium under the contract shall be paid in full in a single instalment. The insurance premium shall be paid before the insurance contract comes into force, unless otherwise agreed between the Policyholder and the Insurer.

18 Information on the validity of the compulsory civil liability insurance contract for owners of land vehicles in the event of a change in the owner of the insured vehicle
  1. In the event of a change in the owner of the insured vehicle as a result of its lawful alienation, the contract shall remain in force until the end of its term, and the rights and obligations of the Insured shall be transferred to the new owner of the specified vehicle.
  2. In the event of the death of the Insured, who is a natural person, his rights and obligations under the contract shall be transferred to the person who has inherited the vehicle specified in such contract and/or who, in the case provided for by the Civil Code of Ukraine, is considered to be the person who has accepted the inheritance.

The right to receive part of the insurance premium in the event of early termination of the insurance contract due to the death of the Insured, who is a natural person, shall pass to the person who inherited the vehicle specified in such contract and/or who, in the case provided for by the Civil Code of Ukraine, is considered to be the person who accepted the inheritance.

3. In the event of a change in the owner of the insured vehicle, the new owner is obliged to notify the Insurer in writing within 15 calendar days from the date of acquiring ownership of the vehicle and provide the Insurer with their personal data.

19 Information about the MTIBU, including the MTIBU's contact details or a link to the page on the MTIBU website where such information is available

The Motor (Transport) Insurance Bureau of Ukraine (MTIBU) is the only association of insurers that provide compulsory civil liability insurance for owners of land vehicles for damage caused to third parties.

Membership of insurers in the MTIBU is a mandatory condition for carrying out activities related to compulsory civil liability insurance for owners of land vehicles.

The MTIBU is a non-profit organisation and operates in accordance with the Law of Ukraine ‘On Compulsory Insurance of Civil Liability of Owners of Land Vehicles’, Ukrainian legislation and its Articles of Association.

20 The grounds and procedure for making a regulatory payment by the MTIBU in the case provided for in paragraph 4 of Part 1 of Article 43 of the Law of Ukraine ‘On Compulsory Insurance of Civil Liability of Owners of Land Vehicles’, or a link to the page on the MTIBU website where information on the procedure for making regulatory payments is posted

The MTIBU, at the expense of the insurance guarantee fund, makes statutory payments on the terms specified in the Law on Compulsory Motor Third Party Liability Insurance in the event of damage caused:

1) on the territory of member states of the Green Card international motor insurance system by a person whose civil liability is insured under an international insurance agreement by an insurer (its successor), who, on the date of the road traffic accident, did not have the right to provide compulsory civil liability insurance due to the termination of membership in the MTIBU and the expiry of the term specified by the rules established by the Council of the International Motor Insurance Bureau ‘Green Card’, did not make an insurance payment under an international insurance contract, or in the event of the opening of bankruptcy proceedings against such an insurer, or if such an insurer is liquidated - to fulfil its obligations under international insurance contracts;

2) on the territory of member states of the international motor insurance system ‘Green Card’ - by the owner of the vehicle who has provided the relevant authorised bodies of foreign states with an insurance certificate ‘Green Card’ issued on behalf of the insurer - a full member of the MTIBU, provided that such insurer, in accordance with the rules established by the Council of the International Motor Insurance Bureau ‘Green Card’, has not made an insurance payment under an international insurance contract;

3) on the territory of Ukraine - a vehicle registered in a foreign state for which a foreign Green Card insurance certificate was issued, which was valid on the date of the road traffic accident on the territory of Ukraine.

The statutory payments provided for in this part shall be made on the terms and in the amounts specified by the legislation on compulsory civil liability insurance for owners of land vehicles in the state where the road traffic accident occurred, unless other terms and amounts are provided for by the Green Card international motor insurance system.

  1. The MTIBU, at the expense of the relevant centralised insurance reserve fund, pays for the services of persons involved in determining (clarifying) the causes and circumstances of events that are the basis for making statutory payments, determining the amount of damage caused as a result of such events (including paying for the services of persons who provide the MTIBU with information or other services to determine the amount of the statutory payment), bank charges, court fees and other mandatory payments related to the implementation and compensation of statutory payments, and the services of persons who provide the MTIBU with legal services on a contractual basis regarding compensation for statutory payments made.
  2. The MTIBU does not make statutory payments specified in paragraph 3 of this section if the injured parties can satisfy their claims on the basis of other insurance contracts. In such cases, the MTIBU compensates for the part of the damage not compensated to such persons under other insurance contracts.
  3. If the MTIBU, in accordance with the rules of the international motor insurance system ‘Green Card’, has compensated for damage on behalf of an insurer - a member of the MTIBU or on behalf of the owner of a vehicle registered in Ukraine who used a forged or illegally altered insurance certificate abroad and caused a traffic accident, the relevant expenses of the MTIBU and the statutory payments from the insurance guarantee fund shall be compensated in full by such persons to the MTIBU.
  4. The MTIBU has the right to demand compensation from the insurer (its successor) for regulatory payments (taking into account the actual costs of making them) made by the MTIBU to fulfil the obligations of such an insurer at the expense of the relevant MTIBU fund contributed by other insurers, and such an insurer (its successor) is obliged to satisfy such a claim within seven days from the date of its presentation.
21 Procedure for consumers to receive insurance payments under direct settlement of insurance claims (under internal compulsory civil liability insurance agreements for owners of land vehicles)
