Official Rules of the Contest
provisionally titled "Spring with UNIQA"
(hereinafter — the “Rules”)
1. General Provisions
1.1. Contest title — “Spring with UNIQA” (hereinafter — the “Contest”).
1.2. The Organizer of the Contest is PRIVATE JOINT-STOCK COMPANY
“INSURANCE COMPANY UNIQA” (EDRPOU code – 20033533, legal address:
6, Olena Teliha St., letter V, Kyiv, 04112), hereinafter — the “Organizer”.
1.3. The Executor of the Contest is also PRIVATE JOINT-STOCK COMPANY
“INSURANCE COMPANY UNIQA” (same EDRPOU code and legal address), hereinafter — the “Executor”.
1.4. The Contest is held in accordance with these Rules.
1.5. The Rules are posted on the Organizer’s official Facebook and Instagram pages:
https://www.facebook.com/uniqa.official/ and https://www.instagram.com/uniqa_ukraine/ (hereinafter — the “Social Network”).
1.6. The Contest is a type of promotional campaign to advertise the Organizer’s products and increase consumer demand.
1.7. These Rules apply to the Contest.
2. Contest Terms and Conditions
2.1. The Contest is held online on the Organizer’s Official page on the Social Network (see 1.5).
2.2. The Contest is held within the territory of Ukraine controlled by the Ukrainian government, where UNIQA-branded services are available (excluding temporarily occupied territories, areas where state authorities do not operate fully, and contact-line areas — including Crimea, Sevastopol, and certain districts of Donetsk and Luhansk regions as defined by applicable Ukrainian law).
2.2. Contest period: from the announcement posted on the Official Page (on March 17, 2025) until 11:59 PM on March 24, 2025 (“Contest Period”). Winners will be announced on March 25, 2025.
2.2.1. Entries submitted before or after the Contest Period will not be considered.
2.3. To participate, individuals must:
a) be an adult citizen of Ukraine residing in non-occupied territory during the Contest;
b) subscribe to the official page of UNIQA Ukraine on Facebook or @uniqa_ukraine on Instagram and write the phrase “I participate” in the comments,
c) repost the Contest announcement to their own temporary stories;
d) have a public profile until the winner announcement;
e) not be a full-time employee of PJSC “UNIQA IC”.
10 promo codes for 10% discounts on any product of the Organizer will be awarded (5 via Facebook, 5 via Instagram).
2.3.1. The Executor reserves the right to determine the validity of posts and select eligible entries at its own discretion.
2.4. A total of 10 winners (5 per platform) will be randomly selected using https://www.random.org/lists/ on March 25, 2025 between 15:00 and 17:00.
2.4.1. The prize draw is not a lottery, gambling game, or gaming service.
2.5. Participants may post multiple entries but will be considered as one participant and eligible for only one prize.
2.6. Terms for determining winners and prize distribution are outlined in sections 6 and 7.
3. Eligibility Requirements
3.1. Participants must meet the conditions set out in these Rules.
3.2. The following are not eligible:
minors or individuals with limited legal capacity;
non-citizens of Ukraine;
those who have not lived in Ukraine for the past 3 years;
employees of the Organizer/Executor, their relatives, or those involved in organizing the Contest.
3.3. Participants must have a personal account created at least 1 month before the Contest. The profile must be publicly accessible.
3.4. Disagreement with these Rules, refusal or withdrawal of consent to process personal data, or failure to comply with the Rules disqualifies the participant.
3.5. Providing false or inaccurate data disqualifies the participant.
3.6. Participants causing damages to the Organizer must fully compensate such damages.
4. Participant Rights and Obligations
4.1. Participants have the right to:
take part in the Contest under the stated conditions;
receive Contest information from the Executor;
accept or decline the prize if selected as a Winner and all requirements are met.
4.2. Participants must fulfill the requirements of section 7 to claim a prize.
4.3. Participation under clause 2.3 confirms full agreement with these Rules.
5. Rights and Obligations of the Organizer and the Executor of the Contest
5.1. The Organizer / Executor has the right to:
- deny a Participant entry to the Contest if the Participant’s registration in the social network is deemed fake (e.g., the account was created outside the timeframe set by these Rules; the name and/or surname in the social network does not match the passport details; most photos or videos on the account appear not to belong to the person providing passport data (excluding reposts); the account is found to be created or managed by a third party, etc.). The Organizer independently determines and verifies such facts at its sole discretion;
- change the terms of the Contest and these Rules and/or cancel the Contest;
- at its sole discretion, disqualify a Participant from further participation in the Contest in case of violation of these Rules, the requirements for the Publication, or applicable laws of Ukraine.
5.2. The Executor is obliged to:
- conduct the Contest in accordance with these Rules;
- provide/send/arrange the delivery of the Rewards to the Contest Winners who have fulfilled all the conditions outlined in these Rules.
6. Contest Rewards
6.1. Ten (10) participants who have fulfilled the conditions specified in clause 2.3 of these Rules and other provisions shall be recognized as Winners.
6.2. The reward consists of ten promo codes for a discount on any insurance product of the Contest Organizer (five promo codes for Facebook participants and five promo codes for Instagram participants). Each promo code provides a fixed 10% discount on any selected insurance product of the Organizer.
6.3. If a participant fails to meet all the requirements of the Rules, or their Publication does not comply with the criteria, they will not be eligible to win the Contest.
6.4. The list of Winners will be published in a comment tagging their accounts under the Contest announcement post on the official Facebook and Instagram pages of PJSC “IC UNIQA”.
6.5. The type (amount) of the Reward from clause 2.3 is determined by the Organizer at its sole discretion. The Organizer independently defines the characteristics of the Reward and reserves the right to change the type/brand/format/quantity/list of Rewards without additional notification. The Organizer may increase the total number of Rewards or include additional ones not initially specified, which will be announced on the Official Page.
6.6. The decision regarding the determination of Contest Winners is final and not subject to appeal.
7. Procedure, Conditions, and Terms of Receiving the Rewards
7.1. The Executor provides information about receiving the Reward via a personal message in the social network to the Winner's account from which the Publication was made. The message will not be re-sent. The Reward is provided within 60 days from the announcement of Winners and is subject to external factors.
The Organizer may ask the Winner to complete a Questionnaire and specify the deadline and return procedure.
7.2. Upon receiving the message, the Winner may use or refuse the Reward.
7.3. The Winner must respond within two calendar days confirming their readiness to receive the Reward. If the Reward exceeds the taxable value as per the Tax Code of Ukraine, the Winner must send the following to the Executor’s corporate email (indicated in the message):
- Copies of the first and second pages of their passport;
- Copy of taxpayer card;
- Personal mobile number;
- Full residential address;
- Closest postal office number, if requested.
The Executor may request additional data/documents or waive the requirement at its discretion to ensure lawful processing and identity verification.
7.4. The Reward is granted only to the Winner who earned it according to these Rules and exclusively in the prescribed manner. Full compliance with these Rules and submission of the required information is mandatory. Failure to comply disqualifies the Winner, who is then considered to have refused the Reward and shall not receive any compensation.
7.5. The Reward cannot be exchanged or replaced with other benefits. Rewards are non-refundable and non-exchangeable. If the Winner is unable to receive the Reward personally, they cannot transfer it to a third party.
8. Taxation
The calculation, withholding, and payment of all taxes and mandatory fees to the state budget, as required by the current legislation of Ukraine, arising from the Incentives, shall be carried out by the Contest Executor in accordance with the applicable laws of Ukraine.
9. Legal Disclaimers
9.1. Participants are responsible for the accuracy of the information they provide.
9.2. By participating in the Contest, Participants confirm that they have read these Rules and fully and unconditionally agree to them, and consent to the Organizer processing and sharing their personal data in accordance with current legislation.
9.3. In accordance with the Law of Ukraine “On Personal Data Protection” (hereinafter – the Law), Contest Participants are hereby informed of the following:
9.3.1. The data controller of the Participants’ personal data is the Organizer.
9.3.2. Participants' personal data is processed for the purposes of enabling participation in the Contest, marketing relations, advertising relations, tax reporting, and accounting.
9.3.3. For the purposes of data processing outlined in these Rules, the full name and contact phone number of the Winner will be processed. Additionally, in the case of Winners, their passport details, taxpayer identification number (TIN), and address of residence or temporary stay may also be processed. The terms of such processing are specified in Clause 7.3 of these Rules. This data is processed to comply with the Tax Code of Ukraine. If such personal data is processed by the Organizer, it will be stored for no more than three (3) years from the date the Winner receives the Incentive.
9.3.4. The following actions may be taken with the personal data: collection, accumulation, storage, adaptation, modification, updating, use and dissemination (distribution, transfer), depersonalization, and destruction.
9.3.5. The data processor of the Participants’ personal data is the Organizer and any third parties engaged by them. Such parties are granted all rights and obligations as provided by the Law.
9.3.6. Furthermore, the transfer of Participants’ personal data to third parties without the consent of the data subject or their authorized representative is permitted in cases established by the Law and only (if necessary) in the interests of national security, economic well-being, and human rights.
9.3.7. Participants’ personal data will be processed from the moment of its receipt and throughout the Contest Period. Thereafter, it will be destroyed upon expiration of the applicable data retention period. The data will be stored for the term required by Ukrainian law for the fulfillment of the Contest’s purposes, after which it will be deleted. Data processing will take place at the Organizer’s/Executor’s address, as indicated in these Rules.
9.3.8. Participants may withdraw their consent to the processing of personal data by sending a written request to the data controller at the Organizer’s legal address specified in Section 1 of these Rules.
9.3.9. Participants retain all rights granted by Article 8 of the Law.
9.4. In the event of ambiguous interpretation of the Rules, any disputes, and/or issues not regulated by these Rules, the final decision shall be made by the Organizer. Such decisions are final and not subject to appeal.
9.5. During or after the Contest, the Organizer is not obligated to correspond with potential Participants or provide oral or written explanations regarding the Contest terms.
9.6. In accordance with Articles 307 and 308 of the Civil Code of Ukraine, by participating in the Contest, a Participant consents to the public display, reproduction, and distribution of their image in videos, photographs, and other visual materials and elements that are part of the Submission. The Participant also confirms the transfer to the Organizer of all exclusive property copyrights and related rights to the Submission as defined by Ukrainian legislation, including but not limited to Article 15 of the Law of Ukraine “On Copyright and Related Rights,” including the following:
- the exclusive right to use the Submission (in whole or in part, without time or territorial restrictions, in any form and by any means – including publication, public display, dissemination by any means, copying, editing, and use for third-party advertising purposes);
- the exclusive right to authorize the use of the Submission;
- the right to prevent unauthorized use of the Submission, including the right to prohibit such use;
- other copyrights and related rights established by Ukrainian law and international treaties ratified by Ukraine.
By participating in the Contest, the Participant confirms that they have no restrictions regarding the transfer of such rights. In case of disputes over the rights to all or parts of the Submission, the Participant agrees to independently resolve all claims at their own expense.
The Organizer/Executor is not responsible for the content of the information provided by Participants and bears no liability to third parties for any violations of copyright or related rights in the materials, including illustrations or photos submitted by Participants. The Participant understands that the Organizer/Executor bears no responsibility for the content of any Submission uploaded under the terms set out in these Rules.
The Participant agrees that the use of their Submission and its components under the conditions defined in the Rules does not give rise to any financial compensation, including royalties.
9.7. All copyrights, trademark rights, and other intellectual property rights associated with the Official Pages belong to the Organizer. Aside from the limited right to use the Official Pages as outlined in these Rules, and other rights explicitly granted by the Rules, Participants are not granted any additional rights related to the use of the Official Pages or the Organizer’s intellectual property. Participants may print or share information and content from the Official Pages only for personal, non-commercial purposes.
10. Other Provisions
10.1. The Organizer reserves the right to unilaterally amend and/or supplement these Rules with mandatory notification published on the Official Pages. Such amendments shall take effect from the moment of publication on the Official Pages unless otherwise provided by the terms of the amendments/supplements.
10.2. The Organizer has the right to terminate the Contest and/or change its duration, notifying Participants on the Official Pages.
10.3. Participants are solely responsible for familiarizing themselves with the Rules and any amendments thereto.
10.4. Participation in the Contest implies the Participants’ consent that their names, surnames, images, photographs, interviews, and other materials about them may be used by the Organizer for advertising purposes, including publication on the Official Pages, without time or territorial limitations, without additional compensation, and without the need for additional written consent from the Participants.
10.5. In the event of any disputes related to the Contest, the Participant must send a written claim to the Organizer at the address specified in Clause 1.1 of these Rules within five (5) business days from the occurrence of the disputed situation. The claim must include the Participant’s full name, address, the essence of the claim, justification, and signature.
10.6. Any disputes arising from these Rules shall be resolved through negotiations. If it is not possible to resolve the dispute through negotiations, it shall be considered in accordance with the legislation of Ukraine.
10.7. The Organizer shall not be held responsible for:
10.7.1. the inability to contact the Winner due to reasons beyond the Organizer’s control;
10.7.2. the Winner’s inability to receive the Prize due to reasons beyond the Organizer’s control;
10.7.3. malfunctions in the operation of communication providers, internet providers, or postal services, as a result of which messages sent to Participants were not received or were delayed;
10.7.4. any expenses incurred by the Winners in connection with their participation in the Contest and/or receipt of the Prize.
10.8. If, for any reason, the fulfillment of these Rules becomes impossible (including, but not limited to, due to force majeure, disruptions in communication networks, interference by third parties, and/or other circumstances), the Organizer reserves the right to cancel, suspend, amend, or temporarily discontinue the Contest.
10.9. Participation in the Contest signifies that the Participant has read and fully agrees with these Rules.
10.10. These Rules are drafted in Ukrainian and may be translated into other languages. In the event of discrepancies between the Ukrainian version and a version in another language, the Ukrainian version shall prevail.
